Lasting Power of Attorney
As you get older you may wish to appoint a friend or family member to look after your finances, and a lasting power of attorney will enable you to achieve this. Once created a lasting power of attorney will continue even in the unfortunate event of loss of mental capacity. In such a case you will have the security of knowing that your affairs are in safe and chosen hands.
There are two types of lasting power of attorney.
Property and Financial Affairs
Very often people find it convenient for someone to deal with the pension authorities, banks and other financial institutions on their behalf and generally deal with their property money and related affairs. This document enables you to do so. Should you so choose, it may be used by your attorneys, even if you still have mental capacity.
Health and Welfare
This enables your attorneys to make decisions about your health and personal welfare for when you are unable to make such decisions for yourself. This can only be used by your attorneys should you become mentally incapable.
Our fees for each lasting power of attorney are:
Individual Single: £300.00 + VAT
Individual both: £450.00 + VAT
Husband and wife single/ Same sex married couples (one each): £450.00 + VAT
Husband and wife/ Same sex married couples both: £700.00 + VAT
Please note our fees include the work involved in the preparation of the LPA and registering the same with the Office for the Public Guardian but they exclude the court fee.
Before a lasting power of attorney can be used it has to be registered with the Office of the Public Guardian. There is a registration fee payable on each application which is currently £82.00. It may be possible to obtain an exemption or remission of such fees.
